General conditions

PRICES AND PAYMENT CONDITIONS:

The prices applicable in our rates will be applied at the time of confirming and accepting the order. Horticultura Técnica S.L.U. reserves the right to modify, at any time and on the basis of the concept that so requires, the prices of the rates without prior notice, solely maintaining the prices of the orders previously carried out and confirmed, and provided that the goods are located in our warehouses.

Our prices do not include VAT nor any other type of tax, and it is understood that this shall be added to all customers with the exception of customers in the Canary Islands and abroad.

Once the customer has been notified of the amount of the invoice, he shall have 5 working days to carry out the payment; if the customer does not make the payment within this period, the company reserves the right to make this material available to other customers.

MINIMUM SALE:

This is €150 net; for smaller quantities due to refunds or advance payment, these shall be made via bank transfer.

The minimum sale at the counter is €150.

ORDERS AND SHIPMENTS:

Orders should be made via our website www.hortitec.es; in the event that it is possible, they may be made in writing to the following email address: [email protected].

In the event that it is not possible to make them in writing, they may be made by phone at the number 96 242 63 70.

All orders made via the website shall take preference over those made by email or phone.

The shipping dates stipulated by the customer are not binding for Horticultura Técnica S.L.U., except with express written approval on our part. The delivery periods shall be confirmed according to stock. Shipments shall be made from 24 hours after making the payment (it is recommended to forward the payment receipt via email, indicating your name and the number of the invoice/order).

The shipments shall be made via the channel that Horticultura Técnica S.L.U. deems most convenient, unless otherwise stipulated by the customer, who shall assume any additional costs that arise in this event.

If any goods arrive with defects or if the incorrect number of packages or contents of the shipment arrive, this should be reflected in the delivery note of the carrier and communicated to Horticultura Técnica S.L.U. within the following 24 hours in order to process the corresponding claim. Claims made outside of this period shall not be addressed, since the insurance covering the goods only covers the first 24 hours.

The commitment made by the transport companies does not bind Horticultura Técnica S.L.U. to comply with a delivery date, since this service is external to the company.

SHIPMENTS

PARCELS weighing less than 12 kilos. 24/48-hr service.

  • If the net amount exceeds €150, CARRIAGE PAID for 1 package (consult for additional packages)
  • If the net amount does not exceed €150, €8 shall be added per package

PALLETS

  • Area 1: Albacete, Alicante, Barcelona, Castellón, Gerona, Lérida, Madrid, Murcia, Tarragona, Valencia, Zaragoza
  • Area 2: Álava, Almeria, Cuenca, Guadalajara, Guipúzcoa, Huesca, La Rioja, Málaga, Navarra, Sevilla, Teruel, Toledo, Vizcaya.
  • Area 3: Asturias, Ávila, Badajoz, Burgos, Cáceres, Cádiz, Cantabria, Ciudad Real, Córdoba, Granada, Huelva, Ibiza, Jaén, La Coruña, Segovia, Soria, Valladolid, León, Lugo, Menorca, Orense, Palencia, Palma de Mallorca, Pontevedra, Salamanca, Zamora y PORTUGAL.

PALLETS. 24/48/72-hr SERVICE AREA 1.

If the net amount does not exceed 1300 euros per Euro pallet or 600 euros per mini pallet, the following carriage fees shall be charged for multi-product pallets:

  • Mini Palet 28 €
  • Pallet (European/American) €40 (maximum 15 bags of substrate)
  • Full pallet of substrate €70

PALLETS. 24/48/72-hr SERVICE AREA 2.

If the net amount does not exceed 1300 euros per Euro pallet or 600 euros per mini pallet, the following carriage fees shall be charged for multi-product pallets:

  • Mini Palet 30 €
  • Pallet (European/American) €45 (maximum 15 bags of substrate)
  • Full pallet of substrate €75

PALLETS. 24/48/72-hr SERVICE AREA 2.

If the net amount does not exceed 1300 euros per Euro pallet or 600 euros per mini pallet, the following carriage fees shall be charged for multi-product pallets:

  • Mini Palet 35 €
  • Palet (europeo/americano) €50 (maximum 15 bags of substrate)
  • Full pallet of substrate €80

NET AMOUNT SUPERIOR TO €1300. AREAS 1, 2 AND 3.

If the net amount is superior to €1300 in Area 1, Area 2 and Area 3, the carriage of the pallet shall be covered. Similarly, the carriage of additional pallets shall be covered by increasing the order by €500 net per pallet. Based on these conditions, the following table shall apply:

  • €1300 = carriage paid for 1 “multi-product” pallet (in the case of a mini pallet, carriage is paid from €600)
  • €1800 = carriage paid for 1 “multi-product” pallet + carriage paid for 1 pallet (substrate or “multi-product”)
  • €2300 = carriage paid for 1 “multi-product” pallet + carriage paid for 2 pallets (substrate or “multi-product”)
  • €2800 = carriage paid for 1 “multi-product” pallet + carriage paid for 3 pallets (substrate or “multi-product”)
  • €3300 = carriage paid for 1 “multi-product” pallet + carriage paid for 4 pallets (substrate or “multi-product”)
  • €3800 = carriage paid for 1 “multi-product” pallet + carriage paid for 5 pallets (substrate or “multi-product”)

And so on successively.

We consider a “multi-product” pallet to be a pallet that contains cultivation products except substrate or a maximum of 15 bags of substrate.

SHIPPING TO THE CANARY ISLANDS

PARCELS WEIGHING LESS THAN 10 KG. 24/48/72-HR SERVICE

  • If the net amount exceeds 400 euros, CARRIAGE PAID
  • If the net amount does not exceed 400 euros, 20 euros shall be added per package

PALLETS. SERVICES TO CANARY ISLANDS (TRANSIT TIME OF 1 WEEK IF ORDERS ARE PLACED BEFORE WEDNESDAY)

If the net amount does not exceed 1250 euros, the following carriage fees shall be charged for multi-product pallets:
  • Mini pallet: €60
  • Pallet (European/American): €110

If the net amount is superior to 1500 euros, the carriage of the pallet shall be covered. Similarly, the carriage of additional pallets shall be covered by increasing the order by 500 euros net per additional pallet. Based on these conditions, the following table shall apply:

  • 1500 €: carriage paid for 1 “multi-product” pallet"
  • 2000 €: carriage paid for 1 “multi-product” pallet + carriage paid for 1 pallet of substrate or 1 “multi-product”"
  • 2500 €: carriage paid for 1 “multi-product” pallet + carriage paid for 2 pallets of substrate or 2 “multi-product”

DISTRIBUTION BY HORTITEC itself in the provinces of Castellón, Valencia, Alicante, Gerona and Barcelona.

The minimum order for distribution is €400 of multi-product material with a maximum of 10 bags of substrate and the option of 1 full pallet of substrate without handling (mono-reference pallet) with carriage paid; otherwise, the carriage corresponding to area 1 shall be charged. The pallets of substrate shall always be delivered via a transport company and not as part of the Hortitec distribution, as our vehicles have a weight limit.

This is a voluntary and free service provided by Hortitec to its customers, and as such, is free from all obligation, i.e. under no circumstances is it demandable by the customer nor obligatory for Hortitec. Orders shall be shipped using transport agencies if Hortitec deems it necessary/unavoidable.

Distribution shall be carried out once per week in each area and via an agency in the case of an excess of orders or unforeseen events. The established delivery days may vary in the event of public holidays during the week.

Orders placed outside of the distribution route days shall be delivered at the prices of the service of the agency in Area 1 in the case of pallets or of parcels in the case of boxes weighing less than 12 kilos.

Important: orders must be placed before 5:30 p.m. the day before distribution.

LEGAL BASIS

Horticultura Técnica S.L.U. is aware of the consumer's rights and adopts the following legal basis for its policy on warranties and returns:

  • Law 7/96 of 15 January 1996 on the Regulation of Retail Trade (Official State Gazette of 17 January 1996)
  • Royal Legislative Decree 1/2007, revised Text of the Law for the Defence of Consumers and Users and other complementary laws amended by Law 3/2014
  • Law 22/2007 of 11 July 2007 on distance marketing of financial services intended for consumers
  • Directive 2011/83/EU on consumer rights
  • Directive 1999/44/EC

RETURNS

Returns of defective products / Warranty
As set out in the main standard of Royal Legislative Decree 1/2007, of 16 November, products sold by www.hortitec.es to its customers, in purchases made from 1 January 2022, have a warranty period of 3 years starting from the date of receipt of the goods. Purchases made before the indicated date have a warranty period of 2 years.

Hortitec shall not be liable for claims derived from third parties against its customers.

Hortitec shall be responsible for proof of the defective product during the first 6 months, although from the 6th month to the 2nd year, accreditation of the defective product shall be the responsibility of the customer, by way of a professional expert report providing evidence that the cause existed before and was in the product and is not derived from the use or wear thereof.

Upon receipt of the product and subsequent review, pursuant to Royal Legislative Decree 1/2007 of 16 November, the sum of the product shall be refunded in the form of credit.


Return of products in good condition / Cancelation
The customer, according to Royal Legislative Decree 1/2007, may return the product or products within 14 days without giving any justification, with the exception of custom-made or customized items as set out in Law 3/2014 This cancelation period shall expire 14 calendar days after receipt of the product. Returns shall not be accepted after the expiry of 14 calendar days from receipt of the goods, except in cases in which the product or products acquired are defective.


How can I return the products?
To begin the process for returning a product, you should initiate this via www.hortitec.es, going to “my details” and creating an RMA request in which the PRODUCT, BRAND, SERIAL NUMBER AND INVOICE of the order that includes the product or products to be returned are included. Alternatively, you may also contact the Hortitec returns department via email ([email protected]) to request a RETURN MERCHANDISE AUTHORIZATION FORM (RMA). Products with original packaging that is not in perfect condition and that are not perfectly packed shall not be accepted. A refund of the amount shall not be carried out for products that are not in a saleable condition or in the event that the box, packaging, instructions or accessories are missing. Avoid affixing transport labels directly onto the product or its packaging, otherwise the product shall be catalogued as not suitable for return. Please check all products before returning them; returned products that are functioning properly shall be returned to the customer and a technician fee of 40 euros/hour (minimum instalments of 15 minutes) for review and control (labor time) shall be charged. Once we have received the product and verified that everything is in compliance with the conditions specified above, we will refund you for the amount of the items received, excluding the shipping costs, without undue delay and, in any case, at the latest 21 calendar days from the date on which you informed us of your decision to cancel the present contract. We shall carry out said refund using the same payment method used by you for the initial transaction, unless you have expressly arranged otherwise; in any case, you shall not incur any expenses as a result of the refund.

Hortitec, in its capacity as a distributor, and in the face of any potential incidents related to the quality of the products sold, shall only address incidents of its direct customers, revoking those of third parties which, to exercise their rights, should get in contact with the store in which they acquired the product.

INCIDENTS DURING TRANSPORT

Horticultura Técnica S.L.U. recommends observing the following protocol upon receipt of the goods:

Verify the condition of the pallets or packages received. Upon receiving the order, we request that you review the condition of the packages, if possible before they are unloaded from the truck or transport vehicle, taking photos of the packages before unloading if any damage or flaws are observed. In the event that they arrive in very bad condition, it is preferable that they are rejected and we are notified thereof within a maximum period of 24 hours from the delivery attempt in order to handle the incident with the transport company.

Make a note on the carrier’s delivery note. Upon receipt of the order, if it is observed that the pallet or any packages are open or depalletized, wet, damaged, broken or if it is evident that the inside is damaged or flawed, we request that you indicate this on the carrier’s delivery note or PDA with “goods broken”, “goods damaged” or a similar note and take photos of the outside of the damaged packages or products. We kindly request that you do NOT write “pending review”, as this has no effect in claims made to the insurance company. Inform us of this incident within the maximum period of 24 hours from receipt of the goods via [email protected] and keep the damaged goods until they are removed by the transport agency or by Hortitec.

File a claim for the incident during transport. If, upon delivery, you detect that the goods have arrived in bad condition, you should file a claim within the 24 hours following receipt, informing us of the type of incident by email to [email protected].

INCIDENTS WITH ORDERS

For incidents related to orders, such as the lack of a product or the detection of missing pieces, only claims made within the 72 hrs following the receipt thereof shall be accepted.
